Introduction

These Terms of Use ("Terms") govern your access to and use of the **Gossy** mobile application and any related websites, services, or features that link to these Terms (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services. In these Terms, "Gossy", "we", "us", and "our" refer to the provider of the Services, and "you" and "your" refer to the individual user or, where applicable, the entity on whose behalf the user accesses the Services.

These Terms of Use are provided for general informational purposes only and do not constitute legal advice. They may not address all laws or requirements applicable to your specific circumstances. You should have these Terms reviewed and customized by a qualified attorney in each jurisdiction where your app is offered.

Eligibility
- You must be at least 13 years old (or the minimum age in your jurisdiction that permits you to use the Services without parental consent) to use the Services. If you are under the age of majority in your jurisdiction, you may only use the Services with the consent of a parent or legal guardian.
- By using the Services, you represent and warrant that you meet all eligibility requirements and that you are fully able and competent to enter into and comply with these Terms.
- If you do not meet these requirements, you must not access or use the Services.

Account Registration and Security
- You may need to create an account to access certain features of the Services.
- You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- You must promptly notify us if you suspect any unauthorized access to or use of your account.
- We reserve the right to suspend or terminate your account if we believe any information you provide is inaccurate, incomplete, or not current, or if you violate these Terms.

License to Use the Services
- Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a device you own or control, and to access and use the Services for your personal, non-commercial use or internal business purposes (as applicable).
- The Services are licensed, not sold, to you. Gossy and its licensors retain all rights, title, and interest in and to the Services.

User Content
Your Responsibilities
- You are solely responsible for your User Content and your use of the Services.
- You will not create, upload, post, send, or store User Content that is illegal, infringing, or violates any law or regulation; infringes or violates the rights of others; is harmful, fraudulent, deceptive, misleading, or defamatory; is harassing, threatening, abusive, hateful, or discriminatory; contains spam or unsolicited advertising; or contains viruses, malware, or other harmful code.
- You represent and warrant that you have all necessary rights, licenses, and permissions to share your User Content and to grant the licenses described in these Terms.
License You Grant to Us
- By submitting, posting, or sharing User Content in connection with the Services, you grant Gossy a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display such User Content, in any media now known or later developed, solely for operating, providing, improving, and promoting the Services.
- Where permitted by applicable law, you also grant other users a non-exclusive license to access and use your User Content within the Services, consistent with the Services' functionality and these Terms.
- You retain any ownership rights you have in your User Content.
Monitoring and Enforcement
- We are not obligated to monitor User Content and do not endorse any User Content.
- We may remove or modify User Content that we believe violates these Terms or applicable law, or that we deem inappropriate.
- We may suspend or terminate access to the Services for users who repeatedly or seriously violate these Terms.
- We may report suspected illegal activity to law enforcement or other appropriate authorities.
- We assume no liability for any User Content posted, stored, or uploaded by you or any third party, or for any loss or damage thereto.

Prohibited Conduct
- You will not use the Services for any illegal, unauthorized, or harmful purpose, or violate any applicable law, regulation, or third-party rights.
- You will not access or use the Services in a way that could damage, disable, overburden, or impair the Services or interfere with any other party’s use of the Services.
- You will not gain unauthorized access to any systems, networks, or data related to the Services, or attempt to probe, scan, or test the vulnerability of any system or network.
- You will not use automated means (bots, crawlers, scrapers) to access or use the Services except as expressly permitted by us.
- You will not circumvent, remove, or interfere with any security or access-control measures or technical restrictions.
- You will not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App or related software, except to the limited extent allowed by applicable law.
- You will not impersonate any person or entity or misrepresent your affiliation with any person or entity.

Third-Party Services and Links
The Services may integrate with or provide links to third-party websites, apps, services, content, or resources that we do not control. We are not responsible for the availability, accuracy, or content of such third-party services, or for any loss or damage that may arise from your use of them. Your use of third-party services is subject to their own terms and privacy policies; you should review those terms before interacting.

In-App Purchases and Payments (If Applicable)
- If the Services offer in-app purchases, subscriptions, or other paid features, payments may be processed through third-party processors or app stores (such as Apple App Store or Google Play Store).
- Prices, subscription terms, and billing details will be disclosed at the time of purchase, and purchases may be subject to the app store’s terms, including refunds.
- Except as required by applicable law or expressly stated at purchase, all purchases and fees are non-refundable.
- If you do not currently offer in-app purchases or subscriptions, adjust or remove this section to reflect your actual practices.

Intellectual Property
- The Services, including all content, features, and functionality (excluding User Content), are owned by Gossy or its licensors and are protected by copyright, trademark, and other intellectual property laws.
- Without our prior written permission, you must not copy, reproduce, modify, or create derivative works based on the Services; distribute, sell, rent, lease, sublicense, or otherwise exploit any portion of the Services; or use any trademarks, logos, or branding associated with Gossy in a way likely to cause confusion or imply endorsement.
- Any rights not expressly granted are reserved by Gossy and its licensors.

Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and disclose your information. By using the Services, you acknowledge that you have reviewed our Privacy Policy, which is incorporated by reference into these Terms.

Disclaimers
- To the maximum extent permitted by applicable law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
- We do not warrant that the Services will be uninterrupted, secure, or error-free; that defects or errors will be corrected; that the Services will be free of viruses or other harmful components; or that any information or content obtained through the Services will be accurate, reliable, or complete.
- You use the Services at your own risk.

Limitation of Liability
- To the maximum extent permitted by applicable law, in no event shall Gossy, its affiliates, licensors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or in connection with your access to or use of, or inability to access or use, the Services; any conduct or content of other users or third parties; any content obtained through the Services; or unauthorized access, use, or alteration of your transmissions or content.
- In no event shall our total liability for all claims relating to the Services exceed the greater of the amount you paid us, if any, for the Services in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars (US $100).
- Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities; in such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

Indemnification
- You agree to defend, indemnify, and hold harmless Gossy, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, and representatives, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your use of or access to the Services, your User Content, your violation of these Terms or applicable law, or your violation of any rights of a third party.
- We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

Termination
- We may suspend or terminate your access to or use of the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, you pose a risk or possible legal exposure to us or others, or the provision of the Services is no longer commercially viable.
- Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination (including ownership provisions, disclaimers, limitations of liability, and indemnity) will continue in full force and effect.
- You may stop using the Services at any time. If you wish to delete your account, follow the in-app instructions (if available) or contact us.

Governing Law and Dispute Resolution
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively in the courts located in Bucharest, Romania, and you consent to the personal jurisdiction of such courts, unless a different dispute resolution mechanism (such as arbitration) is specified below or required by applicable law. If you intend to propose binding arbitration or another dispute resolution mechanism, or if you operate in a jurisdiction requiring specific consumer dispute resolution terms, customize this section with legal counsel.

Changes to the Services and These Terms
- We may modify or discontinue all or part of the Services at any time, with or without notice, to the extent permitted by law.
- We may update these Terms from time to time. If we make material changes, we will provide notice in accordance with applicable law, which may include updating the "Last updated" date, posting an updated version in the App, or sending a notification.
- Your continued use of the Services after changes indicates acceptance of the updated Terms. If you do not agree, you must stop using the Services.
