Terms of Use

1. Acceptance of Terms & Binding Agreement

Last Updated: December 31, 2025. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "You") and Gossy ("Company", "We", "Us"), the operator of the Gossy web and mobile interface (the "Interface").

Unconditional Acceptance: By connecting a blockchain wallet, accessing the Interface, or signing any transaction via our Relayer/Batcher, you unconditionally agree to these Terms.
Right to Refuse Service: We reserve the absolute right to block, ban, or restrict any wallet address from accessing our Interface for any reason, without notice or recourse.
IF YOU DO NOT AGREE TO THESE TERMS, OR IF YOU ARE UNDER 18 YEARS OF AGE, YOU MUST IMMEDIATELY STOP USING THE SERVICE.

2. Strict Eligibility & Age Restriction (18+)

The Gossy Interface is a strictly adult environment. We enforce a zero-tolerance policy regarding minors.

18+ Requirement: Access by any individual under the age of eighteen (18) is strictly prohibited and constitutes a breach of this contract.
Verification Rights: We reserve the right to implement age-gating mechanisms. If we discover a user is underage, we will immediately sever connection to their wallet and blacklist the address.
Global Compliance: You represent and warrant that you have the full right, power, and authority to enter into this agreement and that your use of the Interface does not violate any applicable law or regulation in your country of residence.

3. The Interface vs. The Protocol (Crucial Liability Waiver)

You must understand the technical distinction between the software we provide and the decentralized network you interact with. This distinction defines the limits of our liability.

The Interface (Our Responsibility): We operate the visual frontend (web/app) that indexes and displays content. We retain full control over this Interface and will remove/hide content that violates our policies.
The Protocol (Smart Contract & IPFS): The GossyCore smart contract and IPFS storage are decentralized, immutable networks. We do not own, control, or operate the blockchain.
Immutability Warning: You acknowledge that once data is written to the Protocol (Blockchain/IPFS), IT CANNOT BE DELETED, EDITED, OR CENSORED.
Release of Liability: You hereby release Gossy from any and all liability regarding the permanence of content on the blockchain. You acknowledge that even if we ban a user from our Interface, their content may remain accessible via other gateways or direct blockchain interaction.

4. Wallet-Based Identity & Security

Non-Custodial: We are a non-custodial service. We never have access to your private keys or seed phrases.
User Responsibility: You are solely responsible for safeguarding your wallet. If you lose your keys, you lose your identity and assets. We cannot recover accounts.
Compromised Wallets: If your wallet is hacked and used to post abusive content, you are responsible for the actions taken by that wallet until you prove otherwise. We reserve the right to ban compromised wallets to protect the community.

5. Community-Driven Governance & Automated Suspension

Gossy utilizes on-chain logic and community consensus to police content. By using the app, you agree to be judged by the community.

Mandatory Feedback: You agree that your participation (voting/reporting) is essential to the ecosystem.
Smart Contract Suspension: You acknowledge that the GossyCore smart contract contains automated logic (e.g., _userModeration mapping) that will automatically suspend your ability to post if you receive a threshold of reports.
Batcher Authority: Transactions on Gossy are often facilitated by a centralized 'Batcher' or 'Relayer' to save gas. We reserve the absolute right to refuse to relay transactions for any wallet we deem abusive, effectively cutting off their access to the Protocol via our services.

6. ZERO TOLERANCE: Prohibited Content & Conduct

The Protocol is permissionless, but our Interface is not. We enforce a strict Zero Tolerance policy. Violations result in immediate Interface Bans and Relayer Blacklisting.

Illegal Content: Any content that violates the laws of Romania, the US, or your local jurisdiction.
CSAM (Child Sexual Abuse Material): STRICTLY PROHIBITED. We will immediately report any wallet uploading CSAM to international authorities (Interpol/FBI) and permanently blacklist the address.
Violence & Terrorism: Content promoting real-world violence, terrorism, or self-harm.
Doxxing: Publishing private, personally identifiable information (PII) of others.
Hate Speech: Content that promotes violence or hatred against individuals or groups based on race, ethnicity, religion, gender, or sexual orientation.
Malicious Use: Using the platform to distribute malware, phishing links, or for bot-driven manipulation.

7. GSX Token & Financial Disclaimers

Not a Security: The GSX token is a utility token for protocol interaction. It is NOT an investment contract, stock, or security.
No Expectation of Profit: You agree that you are not acquiring GSX for speculative purposes.
Volatility Risk: Crypto assets are extremely volatile. You accept the risk of losing all value associated with GSX.
Tax Liability: You are solely responsible for all tax obligations arising from your use of the platform.

8. Intellectual Property

Your License to Us: By posting content, you grant Gossy a worldwide, perpetual, royalty-free, transferable license to host, display, cache, and distribute your content via the Interface.
Public Domain: You acknowledge that writing data to a public blockchain essentially places that data into the public domain regarding accessibility.
Our IP: All code, designs, logos, and trademarks associated with the Gossy Interface are the exclusive property of the Company.

9. COMPREHENSIVE WARRANTY DISCLAIMERS

READ CAREFULLY: THIS SECTION LIMITS YOUR RIGHTS.

"AS IS" SERVICE: THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.
NO FIDUCIARY DUTY: WE ARE NOT YOUR BROKER, LAWYER, OR FIDUCIARY ADVISOR.
SMART CONTRACT RISK: WE DO NOT GUARANTEE THE SECURITY OF THE SMART CONTRACT. BUGS, EXPLOITS, OR HACKS MAY OCCUR. YOU USE THE PROTOCOL AT YOUR OWN RISK.
THIRD PARTY CONTENT: WE ARE NOT RESPONSIBLE FOR THE OFFENSIVE, ILLEGAL, OR OBJECTIONABLE CONTENT POSTED BY OTHER USERS. WE PROVIDE THE TOOLS TO BLOCK THEM, BUT WE CANNOT PREVENT THEM FROM POSTING TO THE BLOCKCHAIN.

10. Indemnification (You Protect Us)

You agree to defend, indemnify, and hold harmless Gossy, its founders, investors, employees, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:

Your use of and access to the Service;
Your violation of any term of these Terms;
Your violation of any third-party right, including without limitation any copyright, property, or privacy right;
Any claim that your Content caused damage to a third party.

11. Limitation of Liability

Liability Cap: TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOSSY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL BE LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) $100 USD.
No Consequential Damages: WE SHALL NOT BE LIABLE FOR ANY LOST PROFITS, DATA LOSS, COST OF PROCUREMENT OF SUBSTITUTE GOODS, OR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

12. Governing Law, Jurisdiction & Arbitration

This Agreement involves a Romanian entity but operates globally. Please read this section carefully.

Governing Law: These Terms are governed by the laws of Romania.
Exclusive Venue: Any dispute not resolved by arbitration shall be brought exclusively in the courts located in Bucharest, Romania.
Class Action Waiver: YOU AGREE THAT YOU MAY ONLY BRING CLAIMS AGAINST GOSSY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13. International Sanctions (OFAC)

You represent and warrant that you are not located in, organized in, or a resident of any country or territory subject to comprehensive U.S. or E.U. sanctions (including Cuba, Iran, North Korea, Syria, or the Crimea region).
You represent that you are not on any list of prohibited or restricted parties (e.g., the U.S. Treasury Department's Specially Designated Nationals List).

14. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
These Terms constitute the entire agreement between you and Gossy regarding the use of the Service.
